Terms of Service
These terms govern your use of the SMPulse mobile app and smpulse.app website ("SMPulse", "the app", "we"). By installing or using the app, you agree to them. If you don't agree, uninstall — there's no other onboarding step to unwind.
1. What SMPulse does
SMPulse reads publicly available TikTok profile and post data on your behalf and turns it into charts, insights, and recommendations. We do not control TikTok and we don't speak for TikTok. We are an independent third-party tool.
2. Acceptable use
Use SMPulse for your own account or for accounts you have explicit permission to analyse. Don't:
- Scrape, reverse-engineer, or republish our app or service.
- Use SMPulse to harass, defame, or impersonate anyone.
- Attempt to bypass rate limits or extract data we don't expose.
- Resell SMPulse output as your own analytics product.
3. Free tier & Pro subscription
SMPulse has a free tier with daily quotas and a paid Pro tier that lifts those limits. Pro is billed through Google Play. Pricing and renewal terms are shown on the in-app paywall and on your Play Store subscription page.
Pro subscriptions auto-renew at the end of each billing period unless you cancel through Google Play at least 24 hours before the renewal date. Refunds follow Google Play's policy.
We may change Pro pricing — if we do, the change applies to new sign-ups and to renewals (Google Play will notify you before the next renewal at the new price). Your current billing period is honoured at the price you signed up for.
4. Data accuracy
We try to keep our numbers accurate but we depend on TikTok's public API. TikTok can change its API, throttle requests, or return stale data without notice. SMPulse is provided "as is" — we don't guarantee that any specific metric will be available, fresh, or correct on any given day.
5. AI Studio
The AI Studio feature generates draft captions using a third-party LLM provider. Output is suggestion-only: review every caption before posting and take responsibility for what you publish. We don't claim authorship of generated text and we don't guarantee originality or accuracy.
6. Account & data deletion
You can stop using SMPulse at any time by uninstalling the app. To wipe your stored data sooner, email hi@smpulse.app from any address — see our Privacy Policy for the details.
7. Termination by us
We may suspend or end access for an installation that violates these terms, abuses the API, or attempts to harm the service. We'll usually warn first. For paid users, any unused portion of a current billing period will be refunded on a pro-rata basis except where Google Play's terms apply.
8. Disclaimers & liability
SMPulse is provided without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app — including (but not limited to) lost followers, missed posts, business losses, or third-party platform changes.
Our total aggregate liability for any claim related to SMPulse is capped at the amount you've paid us in the 12 months preceding the claim (or $50, whichever is greater).
9. Third parties
Trademarks for "TikTok", "Google Play", "Slack", "Discord", "Zapier", and any other third-party service mentioned in the app belong to their respective owners. SMPulse is not endorsed by, affiliated with, or sponsored by TikTok Inc. or its parent company.
10. Governing law
These terms are governed by the laws of Morocco, without regard to its conflict-of-laws rules. Any disputes that can't be resolved by talking first (hi@smpulse.app) shall be brought in the courts of Casablanca.
11. Changes
We can update these terms — if we do, we'll bump the date at the top of this page and, for material changes, show a notice on next app launch. Continued use after a change means you accept the new terms.
